New Delhi: A new twist has emerged in the ongoing legal dispute over late businessman Sunjay Kapur’s estate. His children with actor Karisma Kapoor, Samaira and Kiaan, have filed a fresh plea in the Delhi High Court challenging the authenticity of his alleged will. The court has now directed Sunjay’s wife, Priya Sachdev Kapur, to respond to the petition.
The plea was heard on November 17, following which Joint Registrar (Judicial) Gagandeep Jindal issued notices to Priya Kapur and Shradha Suri Marwah, the executor named in the will. Both have been asked to file their replies within three weeks, with the case next listed for December 16.
What did Karisma Kapoor’s children claim?
According to the new submission, Samaira and Kiaan have alleged that the will presented by Priya is “forged and fabricated” and has been created with the intention of excluding them from their father’s estate. They have also sought inspection of the original will, which was filed in a sealed cover before the court on September 25, along with affidavits supporting its validity.
The plea states, “It is submitted that inspection of the original copy of the alleged will is inter alia necessary for the plaintiffs to take appropriate steps regarding the genuineness of the said document, which cannot be ascertained from the true certified copy supplied to the plaintiffs by defendant number four (Marwah).”
This legal exchange follows Priya Kapur’s earlier argument in court, where her counsel maintained that minor errors in the will cannot be grounds to label it fake. They had said, “A will cannot be called fake because of spelling errors, and they have not even disputed Sunjay Kapur’s signature.” However, Karisma’s children have now directly questioned the authenticity of the signature as well.
In addition to the main plea, Samaira and Kiaan have filed a parallel interim injunction seeking to restrain Priya from alienating them from their father’s assets. The hearing for that application is scheduled for November 20.
