Divorce Case: After a long legal battle of 14 years, the Supreme Court granted divorce to the husband and wife and ended all the cases. The court ordered that the husband will pay Rs 1 crore as permanent alimony for the maintenance of his wife and son.

She was fighting a legal battle with her husband for the maintenance of herself and her child, the final solution of which was given by the Supreme Court. He provided permanent alimony to the woman. Married in 2009, separated in 2010

This matter is related to the marriage of 5 October 2009. Only after a year of marriage, the wife left the house and went to her maternal home. The wife alleged that she faced mental and physical harassment at her in-laws house, due to which she left her in-laws house on April 15, 2010 and went to her maternal home. Meanwhile, on 28 December 2010, she gave birth to a son. Even after the birth of the child, there was no reconciliation between the husband and wife.

Wife filed many cases

In 2013, the wife filed a petition for maintenance for herself and her son under Section 125 of the CrPC. In 2019, she filed another case under Section 12 of the Domestic Violence Act, 2005. On which the trial court ordered the husband to pay Rs 5,000 for rent, Rs 10,000 for the maintenance of his wife, Rs 5,000 for the son’s expenses and Rs 5,000 for his education. That is, the husband was ordered to pay maintenance allowance of Rs 20 thousand every month to his wife. Along with this, compensation of ₹ 4 lakh was also given to the wife under Section 22.

After the verdict in the trial court, both the parties again filed appeals in different courts. In 2021, the Sessions Court upheld the trial court’s order. Subsequently, the High Court rejected the wife’s petition and partially allowed some of the husband’s petitions, thereby setting aside the order of compensation of ₹4 lakh.

Final decision in Supreme Court

Then the matter reached the Supreme Court. Here the wife filed SLP(Crl) No.6685/2024 and the husband filed SLP(Crl) No.14187/2023. The Supreme Court said that the husband will have to pay the maintenance dues already pending. On July 29, 2025, the court informed that as per the statement given by the husband, he is ready to pay ₹ 1,00,00,000 (Rs 1 crore) as permanent alimony for the wife and son in addition to the maintenance already given.

With this agreement, the Supreme Court closed all the ongoing cases between the two. This decision not only ended the 14-year-old dispute of this family. After paying Rs 1 crore, the husband will not have to pay alimony to his wife again.
