Karnataka High Court rejected the divorce petition of the husband on the grounds of cruelty to the wife. The court said that the husband did not want a wife, but a loyal maid. According to the court, compromise and coordination are necessary in married life.
Bengaluru: Wife’s cruelty is not tolerated, divorce is required – Karnataka High Court rejected the husband’s appeal on this argument. The young man had approached the Karnataka High Court against the decision of the Bengaluru Family Court. The court said that he did not want a wife, but a loyal maid. Karnataka High Court also said that in married life both have to compromise.
The division bench of Justices Jayant Banerjee and Umesh Adiga heard the youth’s appeal against the Bengaluru Family Court’s decision on September 15. The family court had rejected the young man’s divorce petition. The family court had said that the wife had succeeded in proving that the husband and his family were unhappy with the dowry.
Stayed together for only 10 days and asked for divorce
According to reports, the couple, who got married in 2015, lived together for only ten days. The young man told that when he was working in America, his wife had gone to work in Singapore. After marriage, the wife refused to live with him in America, after which he initiated divorce proceedings in the family court in 2016. At the same time, the wife told in the High Court that her husband and mother-in-law were unhappy about dowry and property. She also said that her husband did nothing to get her a visa to take her to America. The wife also claimed that her mother-in-law constantly interfered in their life, making it impossible to live a peaceful married life.
Court said- marriage is not a child’s play
After hearing the arguments from both sides, the High Court upheld the order of the Family Court which held that the husband’s expectations were misplaced. The court also said that the statement about the wife being cruel is not true. The court said, “Marriage is not a child’s play. To live a married life, husband and wife have to compromise and adjust to each other.”
The bench further said, “It is clear that the petitioner needed an obedient and loyal maid more than a wife. He had very high expectations from his wife, which included that her spouse should do everything as per his wish. The husband raised minor issues which could have been resolved through mutual discussion and understanding.”
