India Tightens 180-Day Stay Rules for Foreign Visitors, Makes Visa Extensions Harder

Foreign nationals planning a long stay in India will now face stricter immigration rules. The Ministry of Home Affairs (MoHA) has amended registration requirements, removing the extra time previously available after crossing the 180-day stay limit.

The biggest change is simple: register before your permitted stay expires, not after.

India’s New 180-Day Visa Stay Rule

Under the earlier system, some foreign nationals could register with immigration authorities within 14 days after completing 180 days in India.

That grace period is now gone. Visitors holding visas valid for 180 days or less who intend to extend their stay must now complete registration before the end of the permitted 180-day period.

The revised rules also apply to travellers holding longer-validity visas that limit each stay to 180 days. These visitors must register before reaching 180 days of continuous stay or before crossing the permitted cumulative stay limit within a calendar year.

Visa Extensions No Longer a Routine Process

The government is also tightening its approach to visa extension requests. According to the amended framework, permission to remain in India beyond the standard 180-day limit will be granted only in emergent circumstances rather than as a routine administrative approval.

What this really signals is a broader shift toward stricter immigration monitoring, bringing India closer to the compliance-first approach already seen in several major travel destinations.

Relief for Mixed-Nationality Families

While the rules are tougher for long-term foreign residents, there is one easing measure.

The government has removed an administrative burden affecting families where one parent is an Indian citizen and the other is a foreign national. Previously, the birth of a child in India had to be electronically reported within 30 days for visa and exit permit purposes.

What Foreign Visitors Should Do

Authorities are advising eligible visitors to complete registration through the Foreigners Regional Registration Office’s e-FRRO system well before reaching the 180-day threshold.

Failure to comply could lead to:

  • Penalties and fines
  • Problems obtaining visa extensions

  • Possible deportation proceedings in serious cases
