New Delhi/Patna: The student movement that started over the NEET paper leak is no longer just a street fight. An incident that took place during ‘Bihar Bandh’ in Siwan, Bihar has sparked political and legal debate across the country. A police officer was captured on camera firing an AK-47 amid the demonstration. As soon as the video surfaced, the administration took immediate action and suspended the officer, but the matter did not stop here. Now this controversy has directly reached the doorstep of the Supreme Court, where Rajya Sabha MP Manoj Kumar Jha has filed a Public Interest Litigation (PIL) demanding fair investigation and accountability.

On July 25, during the ‘Bihar Bandh’ called in protest against the NEET paper leak, thousands of students took to the streets in many districts including Siwan. It started with a peaceful demonstration, but the situation deteriorated rapidly. Meanwhile, in a video that went viral, Bihar Police officer Abhishek Patel, who was part of the Special Investigation Team (SIT), was seen firing at least three rounds from an AK-47 rifle. As soon as the video went viral, questions began to arise as to why such a deadly weapon was used during crowd control.

Big investigation started after suspension
After the video surfaced, Bihar Police suspended officer Abhishek Patel with immediate effect. A departmental inquiry has been initiated to find out whether the use of the weapon was in accordance with the prescribed police procedure or not. Officials say that if any violation of rules is found, legal action will be taken along with disciplinary action.
Three bullets, three injured… 15 year old Arif is most talked about.
Three protesters were injured in this violence, who are undergoing treatment at Jayaprabha Medanta Hospital in Patna. 15 year old Mohammad Arif is being talked about the most. According to the family, he was not involved in any protest, but was returning home after closing the shop. During this time he got shot in the neck. Doctors have performed successful surgery and removed the bullet and his condition is said to be stable at present. This claim is a matter of investigation.

Three FIRs, 100 named and 200 unknown accused
After the incident, the police have registered three separate FIRs. Around 100 people have been named accused, while a case has also been registered against around 200 unknown people. Police are continuously raiding. So far, about 25 accused have been sent directly to jail after medical examination at Sadar Hospital in Siwan, while raids are going on in search of others. The administration says that those instigating violence will be identified and action will be taken as per law.

Public Interest Litigation (PIL) in Supreme Court: Manoj Jha has filed a petition in the Supreme Court demanding an independent investigation into the suspended policeman firing AK-47 on students and strict punitive action against the guilty officers. After this petition, now the suspense has deepened in the legal circles whether the court will issue any strict instructions to the Nitish government in this matter.

Only after departmental investigation will it be clear whether the use of AK-47 was as per the circumstances or not. Further disciplinary and legal action will be decided based on the investigation report.

There is peace at present in entire Bihar after the use of lathi charge, tear gas and water cannon, but the entry of the Supreme Court and this aggressive stance of the opposition has made it clear that this matter is not going to be calmed down so easily. The Siwan incident has raised many serious questions. Was the use of lethal weapons justified during crowd control? Will the injured students get justice? Will the Supreme Court hearing be able to reveal the truth of this entire matter? And most importantly – will this incident prove to be a change in the way police action will be taken during future student movements?
