Drishyam 3 controversy: Amazon Prime Video issues notice over exclusive streaming rights

Drishyam 3 row explained: There’s a legal battle brewing over Mohanlal’s much-hyped Malayalam thriller, Drishyam 3. Amazon Prime Video says it has the exclusive digital rights and isn’t messing around. They’ve warned others not to strike any unauthorised distribution deals.

On Thursday (April 2), Amazon Seller Services Private Limited sent out an official notice. They made it clear: Aashirvad Cinemas, which produced Drishyam 3, signed an agreement giving Amazon the only rights to release the film online. Prime Video now calls the shots when it comes to streaming the movie.

What did Amazon Prime Video say?

The platform asserted that it is the “sole and exclusive holder of all digital rights for Drishyam 3”, covering several categories including SVOD, TVOD, AVOD, FVOD and EST. The notice further clarified that no other party, including Aashirvad Cinemas, is authorised to sell, license or create third-party interests linked to these rights.

Amazon also cautioned stakeholders in the entertainment industry against entering into any agreements that contradict its exclusivity. It stated that Aashirvad Cinemas, or any of its assignees or licensees, has no authority to commercially deal with the film’s digital rights. The company warned that any such transactions would take place entirely at the “risk and cost of the parties involved”.

In addition, the notice made it clear that the streaming service reserves the right to pursue legal remedies. This could include seeking injunctive relief and damages against individuals or organisations that infringe on its rights or interfere with its contractual arrangement surrounding the film.

The legal wording also introduced several digital distribution terms that often appear in streaming deals. SVOD (Subscription Video on Demand) allows viewers to access content through a monthly or yearly subscription. TVOD (Transactional Video on Demand) involves paying separately for a specific title, even if the viewer already holds a subscription.

Meanwhile, AVOD (Ad-supported Video on Demand) allows users to watch content while viewing advertisements during playback. FVOD (Free Video on Demand) makes the film accessible without a subscription, though ads may still appear. Finally, EST (Electronic Sell-Through) enables users to purchase and permanently own the film digitally, similar to owning a DVD.
