Vijay Mallya’s writ petition seeking account of bank accounts

Vijay Mallya has filed a writ petition in the High Court and said that accounts of his loans, confiscation of assets by banks, freezing of accounts and the amount recovered, all this should be given. Vijay Mallya had taken a loan of Rs 6,200 crore, but banks have recovered Rs 14,000 crore including interest. Demanding an accurate account of this, Vijay Mallya has filed this writ petition.

Contempt case against Mallya, court asked – why did he not appear?

Senior lawyer Sajan Poovayya presented arguments on behalf of Vijay Mallya. The court asked why you did not file a petition in the Company Court, Mallya has not appeared in the contempt case of the Supreme Court. Vijay Mallya has not appeared in the court in many cases. In such a situation, how can a writ petition be filed now? But Sajan Poovayya also strongly defended this.

The court asked how you can ask for accounts from the banks in the writ petition. Responding to this, Sajan Poovayya said that the Debt Recovery Tribunal comes under the High Court. The banks say one thing and the official liquidator says something else. There was a time when UBHL company was a famous company in the world. Dr. Vijay Mallya was the director of UBHL. Sajan Poovayya argued that it is his constitutional right to file a writ petition in the High Court.

The lawyer cited the legal process of London Court

Answering the High Court’s question on Mallya’s non-appearance in the contempt case of the Supreme Court, Sajan Poovayya said that Vijay Mallya is subject to the legal process of the London Court.

Poovayya said- Finance Minister has made it clear in Lok Sabha

Mallya had to repay a loan of Rs 6200 crore, whereas Rs 14,000 crore has been recovered. The Finance Minister himself has presented this account in the Lok Sabha. The process is being continued even after the entire loan has been repaid. Therefore, Dr Vijay Mallya has filed the petition seeking an account of loan recovery, argued the lawyer.

Banks’ lawyers instructed to file objection

Senior advocate Vikram Huilgol presented arguments on behalf of the banks. He said that Mallya has fled the country. If Mallya was innocent then he should have returned to India and participated in the judicial process. They come before the court only when they are needed. Justice Lalita Kanneganti has directed the banks’ counsel to file objections to Poovayya’s arguments. Also, the hearing of the case has been postponed till November 12.
