Wife doing adultery will not get alimony
A Delhi court gave a big verdict regarding the alimony petition of a divorced woman. The court said that the wife living in adultery is not entitled to any kind of maintenance with her husband. The woman accused her husband of harassment. She was married in 1998. In May 2025, the divorce application was approved.
Husband is not giving alimony
Family Court judge Namrata Aggarwal was hearing the petition of the woman. The woman said that her husband is obliged to give her a living allowance legal and morally, but she is not deliberately doing so.
Open truth from DNA test
In this case, the wife’s relationship with a foreign man was detected. The DNA test revealed that the woman is the biological mother of a child, while the husband is not biological. The woman did not challenge the DNA test report. So it was believed that she was involved in adultery. The couple was divorced in May after all the evidence came in the court.
Wife was accused of killing mother -in -law
On hearing the petition, the court said that the wife was accused of killing her mother -in -law, due to which she had to stay in jail for four years. However, he was later acquitted by the court. The court said that the testimony of the parties and the first court’s decision proves that the wife was committing adultery. If the wife is living in adultery, then under Section 125 (4) Criminal Procedure Code (CRPC) she does not get the right to maintenance.

Main things said by the court
The court said that in the order of divorce given in May, it has already been proved that the woman was living in adultery and was not loyal to her husband.
To come to this conclusion, the court resorted to the DNA test report, which revealed that the woman is the biological mother of one of her children, but the husband is not her biological father.
The court said that the woman neither challenged this report nor the previous decision, which makes it clear that she has accepted adultery.
The judge also said that the woman has many assets. From whom she is earning well. There is no need to maintain his children, because only her ex-husband is spending their expenses.
