Madhya Pradesh government is now going to implement a new Tenancy Act to end tenancy related disputes and bring transparency. This Act will clearly determine the rights and duties of both the landlord and tenant.

To whom will this rule apply?

This Act will be applicable to residential commercial properties in both urban and rural areas. Its draft has been prepared by the Urban Development and Housing Department and it will be presented in the Assembly in the upcoming monsoon session.

It is mandatory to vacate the house at the end of the contract

The biggest provision of the new Act is that it will be mandatory for the tenant to vacate the house at the end of the contract period. If he does not do so, the landlord can initiate legal action by complaining to the rent authority. However, in case of disaster (like flood, epidemic etc.) the tenant will not be obliged to vacate the house immediately, but he will have to continue paying rent during that period also.

Will not be able to hire sub-tenants without permission

It has also been made clear in the Act that the tenant will not be able to sub-let the house to any third person without the permission of the landlord. If the tenant does not vacate the house even after the expiry of the contract, it will be mandatory to pay double the rent for the first two months and then four times the rent. This will provide relief to landlords from tenants retaining possession of the rent.

Landlord’s rights limits also fixed

Landlords have also been kept under discipline in this Act. Now they will not be able to harass the tenant without proper reason. At least 24 hours prior notice will be required for repair or inspection.

Landlords cannot disrupt basic facilities like water, electricity, gas, lift, parking. Apart from this, entering the house without prior permission will also be considered a violation of the rules.

Rights of heir after the death of the tenant

If the tenant dies, his legal heir can live in the same house as per the terms of the contract, provided he follows the rules of the contract. This will provide protection to the family members from sudden eviction from the house.
