Sanjay Dutt has a popular luxury nightclub in Pune, which is called Ballr. It is being owned by the Bollywood actor and Heramb Shelke. The Phonographic Performance Limited (PPL) India, the country’s oldest copyright licensing organisation, took action against the nightclub over unauthorised use of copyrighted music. The owners were taken to the court by PPL over the allegations of copyright infringement. As per the latest order passed by the Bombay High Court on August 7, PPL got interim relief from the judiciary, as the judge restrained the nightclub owners from publicly performing or using PPL’s song recordings without obtaining the requisite license.
Bombay HC’s Order Against Sanjay Dutt’s Pune Nightclub
According to Mid-Day, a PPL representative had visited Ballr on June 24. They found chartbusters – including Badtameez Dil, Dard-e-Disco, O Saki Saki, Dus Bahane, Mauja Hi Mauja, Justin Bieber’s What Do You Mean and Dua Lipa’s Levitating – being played at the venue. The songs’ copyrights are held by the licensing organisation.
In the hearing, the mentioned that Ballr had previously obtained a license, but it had expired. They are yet to renew it. Hence, the court restrained the defendants from using PPL’s repertoire without a non-exclusive public performance license.
On the other hand, advocate Hiten Wasan said that the body will continue to identify the unauthorised use of their content and pursue legal action. In the statement, he said, “The ad interim injunction granted by the Bombay High Court sends a clear message that continued unauthorised use of copyrighted music can have serious legal consequences.”
has not yet made any official comment on the case. For the unversed, his nightclub, Ballr, is situated in Kalyani Nagar, Pune. It is considered one of the lavish and largest nightclubs in India.
